I.Payment/Security Deposit
The Tenant(s) shall be obligated to pay the quoted amount at the time of booking in addition to the security deposit in the amount of $500. Payments will be made through the website with the dedicated method. Upon termination of a tenant(s) reservation Rental Agency shall return the Security Deposit within a reasonable amount of time or in accordance with State law, whichever is longest.
II. Pets Under no circumstance shall the Tenant(s) be allowed to have any type of pet on the Property unless a licensed physician has authorized its use due to a psychiatric or physical disability. Unauthorized pets/animals could result in immediate eviction with no refund of rents or deposit.
III. Fees, Taxes, and Deposit Taxes, Fees, and Deposit will be collected upon booking. The Tenant(s) shall not be responsible for any other fee(s) unless otherwise mentioned herein.
IV. Termination Rental Agency has the right to inspect the premises with prior notice in accordance with applicable State laws. Should the Tenant(s) violate any of the terms of these terms and conditions, the rental period shall be terminated immediately in accordance with State law. Tenant(s) waive all rights to process if they fail to vacate the premises upon termination of the rental period. Tenant(s) shall vacate the premises at the expiration time and date the reservation.
V. Utilities The Rental Agency provides the following utilities: Cable, Electricity, Internet, Water, Sewer, and Trash Collection (tenants are responsible for placing trash in exterior bins/dumpsters and putting bins in position for pick-up, if applicable to the unit). See individual listing for more information regarding trash disposal.
VI. Maintenance and Repairs The Tenant(s) shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner. Tenant(s) shall leave the premises in a ready to rent condition at the expiration of the reservation, defined by the Rental Agency as being immediately habitable by the next tenants. Tenants will be responsible for maintenance and repairs should the premises be left in a lesser condition. Tenant(s) agree that the Rental Agency shall deduct from the Security Deposit prior to refund if tenants cause damage to the premises or its furnishings.
VII. Trash Rental Agency requires the Tenant(s) to use the following instructions for trash removal on the Property: Trash must be removed and placed in the exterior receptacle or in the designated area prior to check-out. Directions for trash removal will be in the booklet associated with the home.
VIII. Subletting Tenant(s) shall not be allowed to sublet the Property. Subletting will result in immediate eviction with no refund of rents or deposit and tenant will be subject to legal ramifications.
IX. Quiet Enjoyment The Tenants shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate eviction with no refund of rents or deposit. Any and all noise must be kept to a minimum each night beginning at 10:00 PM. Quite hours as established by Holiday Isle Improvement Association and City of Destin are 10:00 PM-0800 AM daily.
X. Smoking Any and all forms of smoking shall not be permitted inside the Property. All smoking activities MUST occur outside and away from the premises. Smoking on the premises is prohibited. Smoking in or on the premises could result in immediate eviction with no refund of rents or deposit.
XI. Rental Agency's Liability The Tenants and Tenants Guests shall hereby indemnify and hold harmless the Rental Agency and homeowner against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Tenant(s) expressly recognize that any insurance for property damage or loss which the Rental Agency or homeowner may maintain on the property does not cover the personal property of Tenant(s), and that Tenant(s) should purchase their own insurance for Tenant(s) and Guest(s) if such coverage is desired.
XII. Attorney's Fees Tenants agree to pay all reasonable costs, attorneys fees and expenses that shall be made or incurred by Rental Agency enforcing these terms and conditions and cancellation policy.
XIII. Use of Property Tenant(s) expressly acknowledge and agree that these terms and conditions is for transient occupancy of the Property, and that Tenant(s) do not intend to make the property a residence or household. Home shall not be used for any commercial use, such as but not limited to; photography, video production, etc. Any unauthorized use of the property will result in immediate eviction with no refund of rents or deposit and legal ramifications.
XIV. Shortened Stays and Conditions There shall be no refunds of rents due to shortened stays or ruined expectations because of weather or any uncontrollable conditions. Immediate threats of impending natural disasters, such as, hurricanes will be taken in to consideration in this process. In the event of an impending natural disaster, an evacuation order must be issued for the location of the home for consideration of refunds. The rental agency will have the final say on extenuating circumstances in regards to issuing refunds and will do so in a fair and common sense manner.
XV. Showings If the property should go on the MARKET FOR SALE, it may be shown to qualified buyers during the stay of the Tenant(s). Every effort will be made to schedule the showing at a convenient time and not interrupt the day-to-day activities of the Tenant(s). Tenant(s) shall allow reasonable viewings of the Property during standard hours. XV. Firearms Only legally owned and permitted firearms shall be allowed on the premises in accordance with State and local laws.
XVI. Fireworks The Parties agree that Fireworks and other hazardous materials will not be stored in or used in or around the Property.
XVII. Illegal Use Tenant(s) shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this reservation with no refund of rents or deposits.
XVIII. Fire Alarms If the Property has fire alarms the Tenant(s) must notify the Rental Agency without delay if a fire alarm 'chirps' or has a low battery condition.
XIX. Keys There shall be an access code given to the Tenant(s) at the time of possession.
XX. Possessions Valuable items left behind by Tenant(s) will be held with every reasonable effort made to contact in order for a safe return. If items are not claimed for longer than 6 months they shall become the property of the Rental Agency. The Rental Agency shall not be held liable for the condition of said items left by the Tenant(s).
XXI. Notice In the event written notice is required the Parties shall be recognized by the mailing addresses set forth in Section I of these terms and conditions.

XXIII. Governing Law The terms and conditions are governed under the laws in the State where the Property is located.
XXXIII. Lead-Based Disclosure It is acknowledged by the Parties that the Property was not constructed prior to 1978. Therefore, the Lead-Based Paint Disclosure Form is not required per federal law.
XXXIV. Disclosures It is acknowledged by the Parties that the Property may have been constructed prior to 1978 requiring the Buyer and Seller to initial and sign the attached Lead-Based Paint Disclosure Form.
XXXV. Severability In the event any provision or part of these terms and conditions are found to be invalid or unenforceable, only that particular provision or part so found, and not the entire terms and conditions, will be inoperative.
XXXVI. Additional Terms and Conditions and Cancellation Policy In addition to the language stated in these terms and conditions, the Parties agree to the following: Payment- A 50% deposit of the total cost will be sent within 24 hours of the rental agency accepting the reservation. The reservation holder and guests of reservation holder must acknowledge the terms and conditions and cancellation policy, along with the deposit within the allotted time. Failure to acknowledge the terms and conditions and cancellation policy and send the deposit within 24 hours of the reservation will result in your dates being made available for booking by other guests. The remaining balance and security deposit shall be received no later than 31 days prior to check-in. Failure to provide final payment will result in the forfeiture of your deposit and dates of your reservation. Cancellation Policy . A Full refund for cancellations made within 48 hours of booking or IF the check-in date is at least 14 days away or IF the cancellation is more than 30 days prior to check-in. A 50% refund for cancellations made within 30 days and at least 7 days before check-in. No refunds for cancellations made within 7 days of check-in. Security deposit and any fee will be refunded (regardless of the timing of the cancellation) with the refund of the payment in the terms stated above. Refunds are non-negotiable. Security Deposit -$500 A security deposit of $500 will be collected at the time of acknowledging these terms and conditions and cancellation policy. Any damages exceeding $500 are subject to reimbursement and will be charged to the credit card that is provided by the guest. A valid credit card will be required by the guest prior to check-in. Failure to provide a valid credit card will result in guests not being allowed to access the condo. NOTIFY MANAGEMENT IMMEDIATELY of anything that may appear to be damaged or not in a satisfactory manner upon arrival and inspection of the condo. (i.e. stains, broken items, etc.) We strive to ensure that all guests receive the same experience. We rely on our outstanding cleaners to inform us of any inconsistencies, but you may notice something that wasn't obvious at the time. Surveillance or recording devices are present on certain properties - Security cameras are located one the exterior of the condo/home for the safety of all guests. No cameras are within the confines of the condo. Refer to individual listing for specific details on surveillance and recording devices. Additional rules - *Must be 25 years of age.* (Guests under 25 must be accompanied by a parent or legal guardian for the duration of the reservation, Valid ID will be required to check in) - NO 3rd party bookings. Reservation holder must be present. - Guest Occupancy will not exceed the set number. Violations could result in immediate eviction with no refund of rents or deposit. See individual listing for guest occupancy. - All guests must be listed on the reservation prior to check-in. - No pets of any kind are allowed. - Beach towels are stocked at the condo, please to don't remove any linens or bath towels from the home. - Please do not sit on furniture with wet clothing. - Quiet hours are between 10pm-8am. Complaints will be taken seriously and could result in eviction with no refund of rents or deposit. - No Smoking of any kind is permitted in the condo or on the patio. Smoking in the condo or on the patio could result in fines or eviction without any refund of rents or deposit. - No commercial photography or filming is permitted on the premises. - Due to past experiences, towels are not to be used to remove make-up or used to clean anything that will stain/ruin them. Stained/ruined towels or linens will be subject to the loss of the security deposit. - Trash will be disposed in the exterior bins or in the designated area. House manual in each home will have specific instructions. - Be respectful of all neighbors and area surrounding the home. - Thoroughly shake all sand from towels, clothes, etc. outside prior to washing. This helps to prolong the life of washer and dryer and is greatly appreciated. - Rinse or brush all sand off of your person prior to entering the home and especially prior to showering. This helps to prevent drains from clogging and is greatly appreciated. - Trash will be taken out prior to departure. - DO NOT dump grease down the drains. - Only small foods will be disposed of in garbage disposal. - Departure procedures are below and will be attached to the refrigerator and are also located in the house manuals section of this listing. Departure Procedures must be followed in order to receive full refund on security deposit. As you depart, there are a few departure procedures with which we ask your assistance and appreciate very much for helping with. During peak seasons, departure time is 10 am sharp unless other arrangements have been made with the rental manager. These small things will help ensure that there is a smooth transition between guests and will hopefully be reciprocated for you in the future if you choose to stay again. These procedures give the cleaners a head start and allow them to provide the next guests with the same thorough cleaning as you received. Please' -Wash all used towels and dry (cleaning crew will fold them). -Wash the sheets (cleaning crew will put them in the dryer). -Do not wash the slip cover mattress protector, unless absolutely necessary. (Gentle wash cycle warm water/low heat tumble) -Load the dishwasher and run it. Cleaning crew will unload it. -Remove all items from the refrigerator/freezer -Take all trash out to its respective bin or dumpster -If needed, run self-cleaning oven mode the night before your departure - Wash used pots/ pans (Do not put in dishwasher). -Laundry detergent is provided for towels/sheets (2) and (2) for your items -Your code will expire at 10 am the day you check out. Cleaning crew will arrive shortly behind you. -Check all drawers/under the bed, and closets for personal items. THANK YOU and we greatly appreciate your help. XXXVII. Entire Terms, Conditions, and Cancellation Policy The terms and conditions together with any attached addendums or disclosures shall supersede any and all other prior understandings and agreements, either oral or in writing, between the parties with respect to the subject matter hereof and shall constitute the sole and only agreements between the parties with respect to the said Property. All prior negotiations and agreements between the parties with respect to the Property hereof are merged into these terms and conditions. Each party to these terms and conditions acknowledges that no representations, inducements, promises, or agreements, orally or otherwise, have been made by any party or by anyone acting on behalf of any party, which are not embodied in these terms and conditions and that any agreement, statement or promise that is not contained in these terms and conditions shall not be valid or binding or of any force or effect.
